These Terms and Conditions (“Terms”) govern your access to and use of the official Q Bosilini website (the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site is the official website of Q Bosilini. References to “we,” “us,” or “our” mean Q Bosilini and any person who operates or administers the Site on his behalf.
1. Purpose of the Site
The Site may provide information concerning Q Bosilini, including music, releases, biography, photographs, videos, collaborations, news, social links, business inquiries, and related artist activities.
The Site may change, expand, suspend, or discontinue features or offerings over time.
2. Artist and Intellectual Property Ownership
The existence or operation of this Site does not transfer ownership of Q Bosilini’s artist identity, stage names, legal names, likeness, image, music, compositions, sound recordings, performances, artwork, logos, trademarks, copyrights, publicity rights, or other intellectual property to any website designer, developer, administrator, manager, service provider, or any other party except where a separate written agreement expressly provides otherwise.
Website operators, service providers, managers, distributors, photographers, collaborators, labels, and other third parties may separately own rights in particular materials appearing on the Site.
Nothing on the Site grants a visitor a license to commercially use any artist, music, photograph, video, artwork, logo, trademark, or other protected material except where expressly stated in writing.
3. Permitted Use
You may access and use the Site for lawful personal and informational purposes.
You may not, without authorization:
- reproduce or commercially exploit protected Site content;
- falsely imply endorsement, affiliation, sponsorship, or representation;
- use the Site to violate another person’s rights;
- interfere with Site security or operation;
- attempt unauthorized access to Site systems or data;
- submit malicious code, spam, or fraudulent information;
- scrape or systematically extract Site content for unauthorized commercial use;
- impersonate another person or organization; or
- use the Site for unlawful, fraudulent, abusive, or deceptive purposes.
4. Music and Third-Party Platforms
Music links may direct visitors to third-party services such as Spotify, Apple Music, YouTube, EMPIRE-related destinations, or other digital platforms.
Availability, pricing, subscription requirements, geographic availability, audio quality, catalog information, and other terms on those platforms are controlled by the applicable third party.
A link to a third-party platform does not alter the ownership, licensing, distribution, or contractual status of the underlying music.
5. Business Inquiries
The Site may provide a form for booking, features, collaborations, press, media, and other business inquiries.
Submission of an inquiry:
- does not create a contract;
- does not guarantee a response;
- does not constitute acceptance of an offer;
- does not obligate Q Bosilini or any representative or other party to participate in a project; and
- does not authorize use of Q Bosilini’s name, music, likeness, or intellectual property.
Any binding engagement must be separately agreed to by the authorized parties.
6. Early-Access Signup
The Site no longer offers an early-access or product-notification signup. The signup previously offered was free and did not constitute a purchase or reservation, and does not create any right to purchase or receive a product.
7. No Products or Sales
The Site currently sells no products. If sales are offered in the future, the seller will be identified and separate sale terms, including pricing, shipping, returns, and refunds, will be posted and will apply before any purchase.
8. Third-Party Links and Services
The Site may contain links to websites or services operated by third parties.
Those services are provided for convenience and operate under their own terms, privacy policies, availability, and practices.
We are not responsible for the independent content or practices of an unaffiliated third-party site merely because it is linked from this Site.
9. Website Content and Accuracy
We make reasonable efforts to keep Site information accurate and current, but artist information, release details, product availability, external links, schedules, photographs, credits, and other content may change.
The Site may be corrected or updated without prior notice.
Historical content may describe releases, collaborations, organizations, events, or relationships that are no longer active.
10. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its informational content are provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted operation, error-free access, or permanent availability of any content or third-party service.
Nothing in these Terms excludes warranties or protections that applicable consumer law does not permit to be excluded.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Q Bosilini and authorized Site operators, administrators, managers, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to access the Site.
This limitation does not apply where liability cannot legally be excluded or limited.
12. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the Site, violation of these Terms, or infringement of another person’s rights.
This section does not require a consumer to indemnify a party for conduct for which such indemnification would be unlawful or unenforceable.
13. Privacy
Use of personal information associated with the Site is governed by the Site’s Privacy Policy, which is incorporated into these Terms by reference.
14. Changes in Site Management or Ownership
Q Bosilini may authorize another person or entity to operate, administer, host, manage, fulfill, or maintain some or all of the Site.
The Site itself or its operational responsibilities may also be transferred to another authorized operator or owner.
A change in operator does not, by itself, transfer Q Bosilini’s music, artist identity, intellectual property, or other rights except as provided in an applicable written agreement.
A successor operator may publish updated terms identifying itself and its responsibilities.
15. Changes to These Terms
These Terms may be updated as the Site, service providers, or legal requirements change.
Changes apply prospectively from the effective date stated in the updated Terms unless applicable law requires otherwise.
Terms applicable to a completed transaction will not be retroactively changed in a manner that unlawfully removes a customer’s existing rights.
16. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer law applies.
Any dispute that is properly brought in court will be handled by a court with lawful jurisdiction over the parties and dispute.
17. Severability
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
18. No Waiver
Failure to enforce a provision of these Terms on one occasion does not permanently waive the right to enforce that provision or another provision later.
19. Entire Website Terms
These Terms, together with the Privacy Policy and any additional terms presented for a particular feature or service, constitute the applicable website terms between the visitor and the responsible Site operator concerning use of the Site.
Separate written agreements governing management, distribution, licensing, performances, collaborations, fulfillment, or other professional relationships are not replaced by these public website Terms.
